1. Definitions

In these Terms & Conditions:

  • "We," "Our," "Us" refers to Pinnacle Academy, a financial education provider operating in Singapore.
  • "You," "Your," "Participant" refers to individuals who enroll in our courses or use our services.
  • "Services" refers to all educational programs, courses, consultations, and related materials provided by Pinnacle Academy.
  • "Website" refers to our online presence at pinnaclleeacas.live and all associated pages.
  • "Agreement" refers to these Terms & Conditions along with our Privacy Policy and Cookie Policy.

2. Acceptance of Terms

By enrolling in our courses, using our website, or accessing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and Pinnacle Academy. Your continued use of our services constitutes ongoing acceptance of any updates or modifications to these terms.

3. Eligibility

To enroll in our courses, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete information during registration
  • Comply with all applicable laws and regulations

While our courses are designed for professionals aged 40 and above, enrollment is open to adults of all ages who meet our eligibility requirements and believe our programs align with their learning needs.

4. Course Enrollment and Registration

4.1 Enrollment Process

Course enrollment requires submission of a registration form and payment of applicable fees. Enrollment is confirmed upon receipt of payment and our acceptance of your registration. We reserve the right to decline any enrollment at our discretion.

4.2 Prerequisites

Certain advanced courses may require completion of foundational programs or demonstration of equivalent knowledge. You are responsible for ensuring you meet any stated prerequisites before enrolling.

4.3 Course Capacity

We maintain small group sizes to ensure quality education. Enrollment is processed on a first-come, first-served basis until course capacity is reached. If a course is full, you may be offered enrollment in a subsequent cohort.

5. Fees and Payment

5.1 Course Fees

Course fees are stated in Singapore Dollars (SGD) and are due in full prior to course commencement unless alternative payment arrangements have been agreed in writing. Fees include all course materials, planning tools, and post-course support as outlined in program descriptions.

5.2 Payment Methods

We accept payment via bank transfer, credit card, and other methods as specified during enrollment. Payment processing is handled through secure third-party payment processors.

5.3 Price Changes

Course fees are subject to change. However, any fee changes will not affect courses for which you have already enrolled and paid.

5.4 Refund Policy

Refunds are available under the following conditions:

  • Full refund if you cancel more than 14 days before course start date
  • 50% refund if you cancel 7-14 days before course start date
  • No refund for cancellations made less than 7 days before course start or after course has commenced
  • Full refund if we cancel the course due to insufficient enrollment or other circumstances

6. Course Delivery and Participation

6.1 Course Schedule

Courses are delivered according to the schedule provided at enrollment. We reserve the right to make reasonable adjustments to course schedules, with advance notice to participants.

6.2 Attendance

Regular attendance is expected for optimal learning outcomes. While we understand that occasional absences may occur, we cannot guarantee make-up sessions for missed classes. Recorded sessions may be available for certain programs at our discretion.

6.3 Participation Expectations

Participants are expected to engage respectfully in course activities, complete assigned exercises, and maintain confidentiality regarding other participants' personal financial information shared during sessions.

6.4 Course Cancellation by Provider

We reserve the right to cancel courses due to insufficient enrollment, facilitator illness, or unforeseen circumstances. In such cases, you will receive a full refund or may transfer your enrollment to a future cohort.

7. Intellectual Property

7.1 Our Content

All course materials, including but not limited to presentations, handouts, planning tools, software, and written content, are protected by copyright and remain the intellectual property of Pinnacle Academy. You are granted a limited, non-exclusive license to use these materials solely for your personal financial planning purposes.

7.2 Restrictions

You may not reproduce, distribute, modify, publicly display, or create derivative works from our materials without express written permission. You may not use our materials for commercial purposes or share them with individuals who have not enrolled in our courses.

7.3 Planning Tools and Software

Access to planning software and tools is provided under separate license agreements with third-party providers. Your use of these tools is subject to those providers' terms and conditions.

8. Educational Nature of Services

8.1 Not Financial Planning Services

Our courses provide financial education and skill development. We do not provide personalized financial planning, investment management, or financial product recommendations as regulated financial services. Any planning exercises or consultations are educational in nature and designed to help you develop your own analytical capabilities.

8.2 No Guarantees

While we provide evidence-based education using established financial planning principles, we make no guarantees regarding specific financial outcomes you may achieve by applying the knowledge and skills learned in our courses. Your financial results depend on numerous factors beyond our control, including your individual circumstances, decisions, and market conditions.

8.3 Professional Advice Recommendation

We encourage you to consult with qualified financial professionals regarding significant financial decisions. Our courses are designed to help you work more effectively with such professionals and evaluate their recommendations, not replace their services.

9. Confidentiality

We maintain strict confidentiality regarding any personal financial information you choose to share during individual planning consultations. However, participants in group sessions should recognize that discussions may involve general financial scenarios and should exercise discretion regarding what personal information they choose to disclose.

All participants are expected to maintain confidentiality regarding other participants' personal information shared during courses. Breach of this confidentiality obligation may result in removal from the program without refund.

10. Limitation of Liability

10.1 Service Provided "As Is"

Our educational services are provided "as is" and "as available." While we strive for accuracy and quality, we make no warranties, express or implied, regarding the completeness, accuracy, reliability, or suitability of course content for your specific purposes.

10.2 Liability Cap

To the maximum extent permitted by Singapore law, our total liability to you for any claims arising from or related to our services shall not exceed the fees you paid for the specific course giving rise to the claim.

10.3 Excluded Damages

We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to financial losses, lost profits, or investment losses resulting from decisions you make based on knowledge gained in our courses.

11. Indemnification

You agree to indemnify and hold harmless Pinnacle Academy, its facilitators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these Terms & Conditions or your use of our services in a manner inconsistent with their educational purpose.

12. Termination

We reserve the right to terminate your participation in our courses if you violate these Terms & Conditions, engage in disruptive behavior, fail to maintain confidentiality obligations, or for other reasonable cause. In such cases, no refund will be provided.

You may withdraw from a course subject to our refund policy outlined in Section 5.4.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms & Conditions are governed by the laws of Singapore. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Singapore.

13.2 Informal Resolution

13.3 Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation through the Singapore Mediation Centre before pursuing litigation.

14. General Provisions

14.1 Entire Agreement

These Terms & Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pinnacle Academy regarding our services and supersede all prior agreements or understandings.

14.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not transfer or assign your rights or obligations under these terms without our written consent. We may assign our rights and obligations to another entity in connection with a merger, acquisition, or sale of assets.

14.5 Notice

Notices to you may be provided via email to the address you provided during enrollment or through prominent posting on our website. Notices to us should be sent to [email protected].

15. Modifications to Terms

We may modify these Terms & Conditions at any time by posting updated terms on our website. Material changes will be communicated to enrolled participants via email. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

For courses in which you are already enrolled, the terms in effect at the time of your enrollment shall govern unless changes are required by law.
